Briefing on Special Proceeding. Key points

The Central Office of the Investigative Committee held a briefing on Special Proceeding.  Speakers were the head of the Main Directorate for Combating Organized Crime and Corruption of the Investigative Committee Vladimir Shishko and the head of the Main Investigative Department of the Investigative Committee Evgeny Arkhireev.

During the event, the head of the Main Investigative Department of the Investigative Committee Evgeny Arkhireev, said that the administrators of the extremist groups "Black Book of Belarus", "Punishers of Belarus" and "All violations" are facing up to 12 years in prison.

«The law of July 20 of this year introduced the Special Proceedings institute into the criminal process, which provides for the possibility of referral to court and consideration of criminal cases against persons located outside the Republic of Belarus and evading appearance in the criminal prosecution body who have committed crimes against the peace and security of mankind, against the state, as well as other crimes, creating threats to the national security of the Republic of Belarus», Evgeny Arkhireev said.

The Investigative Committee is investigating criminal cases against organizers and active participants of extremist activities hiding abroad and continuing attempts to destabilize the situation in the country. In criminal cases of this category, sufficient evidence has been collected to complete the proceedings.

«Subject to the CPC provisions, special proceedings have been initiated against citizens of the Republic of Belarus: Dmitry Navosha, Daniil Bogdanovich, Yanina Sazanovich, Olga Vysotskaya, Valeria Zanemonskaya. The said persons are the creators and administrators of the «Black Book of Belarus», «Punishers of Belarus» and «All violations» Telegram channels. They are involved in posting personal data of officials and inciting social discord in the country. The acts of the accused are qualified under Part 3 of Article 2031 (illegal actions with respect to information about private life and personal data) and Part 3 of Article 130 (inciting social hostility or discord) of the Criminal Code, the sanctions of which incur penalties ranging from 5 to 12 years' imprisonment, respectively», Evgeny Arkhireev said.

He also noted that the Investigative Committee has prepared materials of special proceedings against organizers of the boycott of sports events in Belarus and the call for athletes suspending from participating in international contests.

«The required materials for the launch of special proceedings have been prepared in the criminal case against the founders of the extremist formation «Belarusian Sport Solidarity Foundation». The defendants appealed to foreign states and international organizations to boycott a number of sports events on the territory of the Republic of Belarus and not to allow Belarusian athletes to compete», Evgeny Arkhireev said.

«The implementation of special proceedings mechanism will make it possible to bring these persons to criminal responsibility in absentia, to apply confiscation of property, including property registered to other persons in order to conceal it, to apply other measures stipulated by current legislation», the head of the Main Investigative Department added.

The head of the Main Directorate for Combating Organized Crime and Corruption of the Investigative Committee Vladimir Shishko noted that the Investigative Committee has prepared materials for the start of special proceedings against a number of leaders and participants of terrorist organizations and extremist groups.

«The Main Directorate for Combating Organized Crime and Corruption of the Central Office of the Investigative Committee has a number of criminal cases against defendants hiding outside the Republic of Belarus. Taking into account the categories of extremist crimes committed by them, it is planned to conduct special proceedings in the near future, with the transfer of the criminal case upon completion to the prosecutor for referral to court», Vladimir Shishko said.

«I would like to draw attention to the fact that this is not an exhaustive list of criminal cases and defendants in respect of whom the institute of special proceedings will be initiated. Information on the conduct of special proceedings against particular defendants will be posted at the appropriate time on the official website of the Investigative Committee, as stipulated by law», Vladimir Shishko added.

The head of the Main Investigative Department Evgeny Arkhireev noted that the Investigative Committee had prepared materials for the start of special proceedings in the case of the Coordination Council.

«In the near future, the investigation will consider the issue of launching special proceedings against the accused in the case of the so-called Coordination Council on the facts of a conspiracy to seize state power, public calls to action to the detriment of the national security of the Republic of Belarus, organization and active participation in the activities of extremist groups», Evgeny Arkhireev said.
