Professional negligence resulted in 5-year-old child's death in Brest. Investigation details

The Investigative Department of the Administration of the Investigative Committee for Brest region disclosed details of the investigation of a criminal case against ex-head of one of the housing maintenance agency of Brest for professional negligence, which resulted in the accidental death of a child.
According to the investigation, on the October 24 afternoon last year, a 37-year-old woman was walking with her 5-year-old son in a wooded area on the territory of the former military camp. While playing, the kid disappeared from her sight. Having searched in vain for her son, the mother turned to Ministry for Emergency Situations for help. Rescuers who arrived at the scene found the kid's lifeless body in an underground water tank.
The investigator examined the scene and found out that the neck of the tank was not equipped with a hatch or locking device, and the tank itself was hidden under an earthen embankment, not fenced and not marked on the surface.

During the case investigation, official documents were studied. It was established that the water tank was located on the territory serviced by the housing maintenance agency. The duties of the head of the agency included the organization of inspections and review of all potentially dangerous facilities, including paying special attention to the presence and integrity of hatches and restricting unauthorised access to them.
As a result of dishonest attitude towards service, the 38-year-old accused man failed to fulfill official duties assigned to him, did not take measures to survey the entire territory of the former military camp and did not identify an unused facility.
According to the findings of the forensic medical examination, the death of the child was caused by mechanical asphyxia due to the respiratory tract closure with water when drowning.
The head of the housing maintenance agency was charged under Part 2 of Article 428 (professional negligence, resulted in the accidental death of a person) of the Criminal Code of the Republic of Belarus.
