Tried to gain possession of a service weapon, set fire to an official car and a militiaman: investigation completed

The Investigation Department of the Administration of the Investigative Committee for Mogilev region completed the investigation of a criminal case on illegal actions against the State Traffic Inspection officers, of which three residents of Krasnopolye district are accused.

On the morning of August 29 last year, the State Traffic Inspection officers were ensuring the road safety in Krasnopolye. The attention of the officers was attracted by Volkswagen Passat, near which there was a company of young people. Upon check in the database, it was found that the owner of this car was deprived of a driver's license.

After one of the members of the company took the wheel and moved off, the State Traffic Inspection officers chased the car to check the documents. The officers repeatedly demanded to stop the car using flashing beacons and a loud-speaking device. However, the driver defiantly ignored the legal requirements of the State Traffic Inspection officers, increasing the speed of the car to 150 km/h, crossed into oncoming traffic, thus preventing overtaking. The man showed offensive gestures through the window several times, and the passengers of the car began to throw bottles out of the rear window in the direction of the official car.

Near the village of Novoe Zhitye of Krasnopolye district, the driver lost control of the vehicle and sidetracked. There was a driver - a 26-year-old car owner and two passengers, a 28-year-old woman and a 33-year-old man.

Law enforcement officers immediately took measures on detention of the offender, but the driver and his passengers started to behave aggressively and used violence against the militiamen.

Continuing his illegal actions, the driver of Volkswagen Passat took a petrol can from the car trunk, tried to douse the official car and set it on fire with a lighter. However, he could not complete his criminal intent due to circumstances beyond his control, since one of the militiamen, having timely responded to the criminal actions, drove off to a safe distance.

Then the accused doused one of the State Traffic Inspection officers with gasoline and, holding in his hand a lighted lighter near the victim, threatened to burn him alive. At this time, a 33-year-old man tried to snatch the service weapon from the hands of the militiaman. The attackers were not stopped by nine warning shots from the service weapon made by the officers.


As a result, in order to suppress the unlawful actions of the attackers, one of the militiamen made two aimed shots at the legs of the accused. After that, the officers called an ambulance, reported the use of service weapon and provided first aid to the attackers. All three defendants were intoxicated. At the time of the crime, ethyl alcohol in the amount of 2.45 ppm was found in the blood of the driver of Volkswagen Passat.

To establish the circumstances of the incident, the investigators questioned the victims, the accused and witnesses, held confrontations and сcommissioned a number of forensic examinations. The video files extracted from the car dash camera, as well as from the seized personal wearable information recording devices "Dozor", attached to the uniform of the State Traffic Inspection officers, were investigated and attached to the materials of the criminal case.
According to the results of the investigation, depending on the role of each person involved in the crime, the investigators brought charges against:
  • a 26-year-old Volkswagen Passat driver under Article 364 (violence or threat of violence against employees of internal affairs bodies), Part 1 Article 14, Part 2 Article 218 (attempted intentional destruction of or damage to the property, that caused damage on a large scale), Part 4 Article 294 (plunder of firearms committed by a group of persons, by robbery), Part 1 Article 14, clauses 6, 10, Part 2 Article 139 (attempted murder with extreme brutality towards a person in connection with the performance of his/her official activities) of the Criminal Code of the Republic of Belarus;
  • a 33-year-old man under Article 364 (violence or threat of violence against employees of internal affairs bodies) and Part 4 Article 294 (plunder of firearms committed by a group of persons, by robbery) of the Criminal Code of the Republic of Belarus;
  • a 28-year-old woman under Article 364 (violence or threat of violence against employees of internal affairs bodies) of the Criminal Code of the Republic of Belarus.
Pre-trial restrictions in the form of detention were applied to the men, the woman is on house arrest. The defendants partially admitted their guilt and throughout the investigation, in order to avoid responsibility, set out various leads, which were not objectively confirmed by the materials of the criminal case.

The criminal case was transferred to the prosecutor for referral to the court.
